However, no system is 100% secure. You are responsible for securing your devices, passwords, and SIP credentials.

Data RetentionWe retain account and billing data as long as required for regulatory, tax, or legal compliance.Call recordings, voicemails, SMS, and faxes are stored only as long as necessary to deliver the Services, unless you delete them earlier.When deleted, media is permanently removed from our systems within a reasonable time.6. Sharing of InformationWe may share information only with:Service Providers: third parties who help us deliver the Services (e.g., carriers, payment processors).Legal Obligations: regulators, law enforcement, or as required by law.Fraud Prevention: as necessary to detect or prevent abusive activity.We do not sell or rent customer information to third parties.7. Shoutdial Terms of ServiceLast Updated: September 12, 2025Welcome to Shoutdial! These Terms of Service (“Terms”) are a binding agreement between you and Shoutdial, a DBA of Voice Solutions NW LLC (“Shoutdial,” “we,” “us,” or “our”).By using our services (the “Services”), including calling, voicemail, faxing, messaging, or related features, you agree to these Terms and our Fair Use / Acceptable Use Policy (AUP), incorporated herein by reference. If you do not agree, do not use our Services.1. Privacy of Your MediaShoutdial does not claim ownership of, or rights to, your private communications or media (such as call recordings, voicemails, or faxes). These remain your property and are not accessed, distributed, or used by Shoutdial except as required to provide the Services or comply with the law.2. Account Security & ResponsibilityYou are solely responsible for securing your account, SIP credentials, and devices.All usage of your account is your responsibility, whether or not you authorized it.If your credentials are compromised, you remain liable for all usage until Shoutdial confirms receipt of your notice of compromise.3. Fair Use & Acceptable UseYou must comply with Shoutdial’s Fair Use & Acceptable Use Policy (AUP).Violations of the AUP may result in immediate suspension or termination.You are responsible for all charges, including overages or fraudulent traffic, regardless of source.4. Fees & PaymentYou agree to pay all subscription, usage, and overage fees incurred on your account.Charges resulting from compromised credentials, fraud, or unauthorized access remain your responsibility.Fees are non-refundable unless required by law.5. Service AvailabilityServices are provided on an “AS IS” and “AS AVAILABLE” basis. We do not guarantee uninterrupted or error-free operation. Maintenance, upgrades, or outages may interrupt Services without liability.6. Limitation of LiabilityTo the fullest extent permitted by law:Shoutdial is not liable for indirect, incidental, or consequential damages (e.g., lost profits, unauthorized usage charges).Shoutdial’s aggregate liability shall not exceed the greater of $100 or the amount you paid in the past six (6) months.7. IndemnificationYou agree to indemnify and hold harmless Shoutdial, its officers, employees, and affiliates against any claims, damages, losses, or expenses (including attorneys’ fees) arising from:your use of the Services,your violation of these Terms or the AUP, orany claim related to traffic from your account, including fraudulent or unauthorized activity.8. TerminationWe may suspend or terminate your access at any time for:violation of these Terms or the AUP,suspected fraud or abuse, ornon-payment.
All outstanding fees remain immediately due upon termination.
9. Governing LawThese Terms are governed by the laws of the State of Delaware. Any disputes must be brought in the state or federal courts of Delaware.10. Changes to TermsWe may update these Terms or the AUP at any time. Continued use of the Services after changes are posted constitutes acceptance.

11. TERMINATIONWe may terminate or suspend your account and your ability to use the Site or Services immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.Upon termination, your right to use the Site and Services will cease immediately. If you wish to terminate your account, you may simply discontinue using the Site and Services.All provisions of these Terms shall survive termination, including our rights regarding indemnification, disclaimers of warranties, limitations of liability, and dispute resolution.12. GOVERNING LAW AND JURISDICTIONThese Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without giving effect to any principles of conflicts of laws. You can cancel your service at any time and your service will remain active until the end of the current billing cycle. If you are on a yearly plan and wish to terminate service, we will evaluate your situation on a case by case basis to determine if a refund will be applied.2. Conditions for a RefundRefunds can only be processed for accounts that have purchased a yearly subscription. Your refund will include any unused months of service but not include any partial months of service. Your plan can cancelled at the end of the month you request cancellation and a refund will be issued after service is ended.3. Processing RefundsRefund requests are processed within a reasonable timeframe. Refunds are made to the original method of payment. You will be notified once your refund has been issued.4. Shoutdial Fair Use & Acceptable Use Policy (AUP)Effective Date: September 12, 2025Shoutdial provides communications services intended for lawful, legitimate business or personal use. To protect the network, our customers, and the integrity of our services, this Acceptable Use Policy (“AUP”) sets out the rules for use.1. Prohibited UsesYou may not use Shoutdial Services to:Engage in fraud, toll fraud, or hacking, including unauthorized use of SIP credentials or devices.Send spam, robocalls, auto-dialers, or mass unsolicited messaging.Spoof or misrepresent caller ID information.Harass, threaten, or abuse others through calls, messages, or faxes.Transmit unlawful, obscene, defamatory, or infringing content.Resell or provide the Services to third parties without written approval.Interfere with the security or operation of the Services or Shoutdial’s systems.2. Customer ResponsibilityYou are fully responsible for all use of your account, including usage resulting from compromised credentials, hacked phones, or unauthorized access.You must secure your devices, passwords, and SIP credentials.Any traffic originating from your account is deemed authorized by you.3. EnforcementShoutdial may suspend or terminate Services immediately if violations are suspected.You remain responsible for all charges incurred, including overages or fraudulent usage, whether authorized by you or not.Shoutdial reserves the right to investigate violations and cooperate with law enforcement.
